This Payment, Cancellation and Refund Policy (“Policy”) governs the payment of fees, payment by instalments, cancellation of enrolment and refund of amounts paid in respect of certificate programmes offered by Nutrition & Human Health Academy, operated by Helthofit Private Limited (“NHHA”, “we”, “us” or “our”).
This Policy applies to every Candidate who enrols in an NHHA programme or makes any payment towards an NHHA programme.
For the purposes of this Policy, “Programme Fee” means the total fee payable for the specific programme selected by the “Candidate” at the time of enrolment, after applying the price, discount or offer displayed or communicated to the Candidate at that time.
1. Applicability and Legal Framework
This Policy applies to all payments made towards NHHA programmes through the NHHA website, an authorised payment link, payment gateway or any other payment channel authorised by NHHA.
This Policy shall be governed by the laws of India, including any applicable statute, enactment, law, ordinance, regulation, rule, notification, circular, direction, order, judgment, decree, governmental requirement or other legally binding requirement issued by any governmental, statutory, regulatory, judicial or quasi-judicial authority having jurisdiction over a Party or the subject matter of this Policy.
This Policy shall be read together with NHHA's Terms and Conditions and the terms applicable to the specific programme selected by the Candidate.
2. Programme Fees and Pricing
2.1 Applicable Programme Fee
The Programme Fee payable by the Candidate shall be the fee displayed for the selected programme at the time the Candidate completes the enrolment and payment process.
NHHA may offer programmes of different durations and at different prices. The Programme Fee shall depend upon the specific programme selected by the Candidate.
The price applicable to one programme shall not apply to another programme merely because the programmes are offered by NHHA or have similar subject matter.
2.2 Discounts and Promotional Offers
NHHA may offer discounts, promotional pricing or limited-period offers.
A discounted or promotional price shall apply only where:
- the offer was available at the time of the Candidate's enrolment; and
- the Candidate completed enrolment in accordance with the conditions applicable to that offer.
A Candidate who has completed enrolment at a particular Programme Fee shall not be entitled to claim a subsequent discount, promotional offer or reduced price announced after the Candidate's enrolment.
Similarly, a subsequent increase or decrease in the price of a programme shall not alter the Programme Fee already agreed for an existing enrolment.
2.3 Price Changes for Future Enrolments
NHHA may revise the price of any programme for future enrolments.
Any revised price shall apply only to enrolments made after the revised price becomes effective, unless a pricing error or unauthorised transaction has occurred.
3. Payment Options
NHHA may, at its sole discretion, offer the following payment options for its programmes, subject to the payment options made available for the relevant programme at the time of enrolment:
- Lump-Sum Payment: Payment of the complete Programme Fee in a single transaction; or
- Instalment Payment: Payment of the complete Programme Fee in three (3) instalments, in accordance with the payment schedule communicated to the Candidate at the time of enrolment.
The availability of a particular payment option may vary depending upon the programme, batch, offer or enrolment process applicable at the time of enrolment.
Irrespective of the payment option selected, the Candidate's enrolment shall relate to the complete programme and the complete Programme Fee applicable to such programme.
3.1 Lump-Sum Payment
Where a Candidate selects the lump-sum payment option, the complete Programme Fee for the selected programme shall be payable in a single transaction at the time of enrolment or within such period as may be expressly communicated by NHHA.
Where the complete Programme Fee has been successfully paid, the Candidate shall not have any further payment obligation towards the Programme Fee, except for any additional charges, as may be applicable, including but not limited to any taxes, convenience fees, field visit charges, certification charges, etc.
A Candidate who has made a lump-sum payment may submit a request to NHHA in relation to cancellation, withdrawal or any exceptional circumstance. Such request may be considered by NHHA on a case-by-case basis in accordance with this Policy, but shall not by itself create an entitlement to a refund.
3.2 Instalment Payment
Where a Candidate selects the three-instalment payment option, the complete Programme Fee shall be payable in accordance with the instalment schedule communicated to the Candidate at the time of enrolment.
Unless otherwise expressly approved by NHHA in writing as an exceptional arrangement, all three instalments shall be paid and cleared within three (3) months from the date of enrolment.
If a Candidate anticipates difficulty in making an instalment payment for one or more instalments, the Candidate may submit a written request to NHHA for consideration of an alternative payment arrangement.
NHHA may, on a case-by-case basis and at its sole discretion, approve an alternative arrangement or extension. Any such approval shall be valid only if expressly communicated in writing by NHHA.
The submission or review of a request shall not, by itself, extend, waive, suspend or modify the Candidate's existing payment obligation.
NHHA reserves the right to charge an additional convenience fee, interest, and any statutory taxes as may be applicable as per the law being in force for allowing payments in instalments.
4. Payment Obligation and Pending Payments
4.1 Payment Obligation
A Candidate who enrols in a programme agrees to pay the complete Programme Fee applicable to the selected programme, irrespective of whether the Candidate selects the lump-sum payment option or the three-instalment payment option.
The payment option selected by the Candidate determines only the manner and schedule of payment and does not alter the Programme Fee applicable to the programme.
4.2 Lump-Sum Payment
A Candidate who has duly paid the Programme Fee in full under the lump-sum payment option shall be treated as having fully discharged the Candidate's payment obligation in respect of the Programme Fee, except for any additional charges, as may be applicable, including but not limited to any taxes, convenience fees, field visit charges, certification charges, etc.
4.3 Partial Payment Under the Instalment Option
Payment of one or more instalments shall not, by itself, constitute full payment of the Programme Fee. Any unpaid portion of the Programme Fee shall remain outstanding and payable in accordance with the applicable payment schedule, unless otherwise agreed in writing by NHHA.
4.4 Consequences of Pending Payment
Where any amount payable towards the Programme Fee remains unpaid after its applicable due date, NHHA may notify the Candidate regarding the pending payment.
The Candidate may contact NHHA to clarify any payment-related issue or request consideration of an alternative payment arrangement (Clause 4.5) in accordance with the applicable payment schedule discussed with the Candidate at the time of enrolment.
4.4.1 Suspension of Access for Non-Payment
If an instalment remains unpaid after the applicable due date, NHHA may suspend the Candidate's access to further live classes, recorded lectures, course materials or other Programme facilities until the pending payment is cleared or an alternative payment arrangement (Clause 4.5) is expressly approved by NHHA.
NHHA may, where reasonably practicable, provide the Candidate with prior notice of the pending payment / instalment and the possible suspension of access. Suspension of access shall not entitle the Candidate to a refund for any period during which access was suspended due to non-payment.
Unless NHHA expressly agrees otherwise in writing, the outstanding instalment shall remain payable in accordance with the original payment schedule.
4.4.2 Continued Non-Payment
If the Candidate does not clear the pending instalment and no alternative payment arrangement (Clause 4.5) has been approved by NHHA, the Candidate's access may remain suspended. Further, the Candidate shall not be eligible for any certificate from NHHA until and unless the entire amount, as may be due, is paid to NHHA.
Amounts already paid by the Candidate shall remain non-refundable in accordance with this Policy.
4.4.3 Resumption of Access
Subject to the applicable Programme schedule and completion period, NHHA may restore the Candidate's access after the outstanding payment has been cleared or an alternative payment arrangement (Clause 4.5) has been approved by NHHA in writing.
NHHA shall not be required to repeat live classes, extend Programme timelines or recreate time-bound Programme activities solely because the Candidate's access was suspended due to delayed payment.
4.5 Exceptional Alternative Payment Arrangements
NHHA recognises that circumstances affecting a Candidate's ability to make payment may arise.
Accordingly, a Candidate may submit a written request to NHHA for consideration of an exceptional payment arrangement. Any such request shall be considered by NHHA on a case-by-case basis. NHHA may approve, modify or decline the requested arrangement at its sole discretion.
An exceptional payment arrangement shall apply only where NHHA expressly confirms its approval in writing and shall be subject to the terms communicated by NHHA.
An exception approved in one case shall not create a precedent, entitlement or obligation for NHHA to approve a similar request in any other case.
4.6 Voluntary Non-Participation
The following shall not cancel or reduce the Candidate's payment obligation:
- failure to attend live classes;
- failure to watch recorded lectures;
- failure to complete assignments or assessments;
- voluntary withdrawal from the programme;
- discontinuation of participation for personal, professional, academic or financial reasons; or
- a decision by the Candidate not to continue with the programme.
A Candidate who voluntarily stops participating in the programme shall not, merely because of such non-participation, be released from the obligation of payment of any unpaid instalments that have become payable under the payment schedule accepted at enrolment.
5. Delayed or Unpaid Instalments
Where any instalment remains unpaid after its due date, NHHA may:
- send a payment reminder to the Candidate;
- suspend the Candidate's access to live classes, recorded lectures, course materials or other programme content until the overdue amount is paid;
- withhold the Candidate's certificate until the complete Programme Fee has been paid; and/or
- discontinue access to the programme where the Candidate fails to clear the overdue amount within the payment period communicated by NHHA.
Any such suspension or discontinuation of access due to non-payment shall not constitute a refund, cancellation or waiver of any amount already payable under the accepted payment schedule, unless an alternative payment arrangement is drawn up in accordance with Clause 4.5.
6. Cancellation or Withdrawal by the Candidate
6.1 Voluntary Cancellation
A Candidate may communicate their intention to withdraw or discontinue participation in the programme through NHHA's designated contact channel. However, voluntary cancellation, withdrawal or discontinuation shall not entitle the Candidate to a refund of any amount already paid towards the Programme Fee.
6.2 Instalment Enrolments
Where the Candidate has selected payment in three instalments, voluntary cancellation or discontinuation shall not automatically cancel instalments that have already become due under the payment schedule.
The Candidate's payment obligations shall be determined by the payment schedule accepted at the time of enrolment. A Candidate may submit a written request to NHHA for consideration of the circumstances giving rise to the cancellation or withdrawal request.
NHHA may review the request on a case-by-case basis and, at its sole discretion, approve an appropriate accommodation, including an alternative payment arrangement, deferment, adjustment or other resolution considered appropriate by NHHA.
Any accommodation shall be subject to NHHA's prior written approval and any conditions communicated by NHHA.
The submission or review of a request shall not, by itself:
- entitle the Candidate to a refund;
- cancel or waive any outstanding payment obligation;
- modify the applicable payment schedule;
- alter programme completion or certification requirements; or
- create a right to any particular accommodation.
Any exception granted by NHHA shall apply only to the specific Candidate and circumstances for which it has been approved and shall not constitute a precedent or entitlement in any other case.
7. No Refund Policy
7.1 General Rule
Except for the specific circumstances stated in Clause 8 of this Policy, all payments made towards the Programme Fee are final and non-refundable.
No refund shall be issued merely because the Candidate:
- changes their mind after enrolment;
- does not wish to continue the programme;
- does not attend live classes;
- does not access recorded lectures or course material made available to the Candidate;
- is unable to continue due to personal, professional, academic, medical or financial circumstances;
- fails to complete the programme;
- fails to complete assignments, assessments or other programme requirements;
- fails to complete the programme within the prescribed duration; or
- voluntarily withdraws or discontinues participation.
Any refund or financial accommodation approved by NHHA outside the circumstances expressly stated in Clause 8 shall be an exceptional, case-specific decision, taken by NHHA at its sole discretion and shall not create a general right, precedent or entitlement for any other Candidate.
7.2 Partial Completion
A Candidate shall not be entitled to a full or proportionate refund or any waiver whatsoever merely because the Candidate has:
- attended the programme partially;
- completed only partial modules;
- accessed only partial lectures or course materials; or
- chosen not to utilise the full syllabus / modules of the programme.
The Candidate's decision not to utilise programme access or services made available by NHHA shall not create a right to a refund.
8. Limited Refund and Payment Correction Circumstances
A refund shall be processed only in the following circumstances:
8.1 Duplicate Payment
Where NHHA verifies that the same payment transaction has been successfully charged more than once for the same Candidate and the same payment obligation, NHHA shall refund the duplicate amount.
8.2 Excess Payment
Where NHHA verifies that a Candidate has paid an amount exceeding the Programme Fee payable by that Candidate, NHHA shall refund or adjust the excess amount.
8.3 Cancellation of a Programme Before Commencement
Where NHHA cancels the specific programme and batch in which the Candidate is enrolled before the commencement of that programme, and NHHA does not offer the Candidate:
- enrolment in the next available batch of the same programme at no additional Programme Fee; or
- transfer to another NHHA programme of the same value,
the Candidate may elect to receive a refund of the amount paid towards that programme.
For the purposes of this Clause, a programme shall be treated as cancelled only where NHHA communicates that it will not conduct that specific programme or batch.
A rescheduling of classes or commencement dates shall not constitute cancellation of the programme.
8.4 Failure to Provide Confirmed Programme Access
Where:
- the Candidate has successfully completed payment or has made the payment required for commencement of the programme;
- NHHA does not provide the Candidate access to the programme; and
- such failure continues after the Candidate has notified NHHA through its designated support channel and NHHA has failed to resolve the access issue within a reasonable period,
NHHA shall investigate the issue and, where NHHA is unable to provide the Candidate access to the programme, the Candidate shall be entitled to a refund of the amount paid for the programme.
This Clause shall not apply where the Candidate's inability to access the programme is caused by:
- the Candidate providing incorrect contact or registration details;
- the Candidate's internet connection, device or software;
- the Candidate's failure to follow reasonable access instructions provided by NHHA; or
- suspension of access due to non-payment.
8.5 Payment Processing Error
Where a verified technical or payment-processing error results in an incorrect debit from the Candidate, NHHA shall take reasonable steps to correct the error, including refunding the incorrectly charged amount where the amount has been received by NHHA.
9. Refund Exclusions
For clarity, NHHA does not have any obligation to issue a refund merely because:
- the Candidate considers the programme unsuitable after enrolment;
- the Candidate expected an outcome not expressly promised by NHHA;
- the Candidate does not agree with the teaching style or preferences of a particular educator;
- the Candidate is unable to attend classes at the scheduled time;
- the Candidate does not complete the programme;
- the Candidate does not meet the requirements for certification;
- the Candidate has pending or incomplete assignments or assessments; or
- the Candidate chooses to stop participating in the programme.
10. Programme Changes and Rescheduling
NHHA may change the date, time or sequence of classes or replace an educator where necessary for programme administration. NHHA will endeavour to communicate significant schedule changes to affected Candidates through the contact details available in its records.
Such changes shall not constitute cancellation of the programme and shall not create a right to a refund solely because the original schedule or educator has changed.
NHHA shall continue to provide the programme for which the Candidate enrolled, including the core learning content represented for that programme.
Where NHHA permanently discontinues a programme after the Candidate has enrolled and is unable to provide the remaining programme content, NHHA shall communicate the available resolution to the affected Candidate, including transfer to another batch, transfer to another programme or a refund of the amount attributable to the undelivered portion of the programme, at its sole discretion.
11. Certification and Payment
A certificate shall not be issued until:
- the Candidate has satisfied the completion requirements applicable to the programme; and
- the complete Programme Fee and all instalments payable by the Candidate have been received by NHHA.
Payment of only a part of the Programme Fee shall not create an entitlement to a certificate.
Similarly, completion of the academic requirements without full payment of the Programme Fee shall not create an entitlement to receive the certificate until all outstanding amounts payable by the Candidate have been cleared.
12. Non-Transferability of Programme Fees
Programme Fees are personal to the enrolled Candidate and are non-transferable.
Accordingly, amounts paid towards a programme may not be:
- transferred to another individual;
- converted into cash;
- transferred to another programme; or
- transferred to another batch,
except where NHHA expressly agrees, at its sole discretion, to such transfer in writing.
Any transfer expressly approved by NHHA shall be subject to the terms communicated by NHHA at the time of approval.
13. Refund Requests and Payment Queries
Any request relating to:
- a duplicate payment;
- an excess payment;
- a payment-processing error; or
- a refund claimed under Clause 8,
must be submitted to NHHA through the designated support or contact channel.
The Candidate shall provide sufficient information to enable NHHA to identify the relevant transaction, including the Candidate's name, registered contact details, programme name, payment date and transaction reference, where available.
NHHA may request additional information where reasonably necessary to verify the transaction.
14. Processing of Approved Refunds
Where a refund is payable under Clause 8, NHHA shall process the refund after verification of the relevant payment and enrolment records within 90 days.
The refund shall ordinarily be made to the original payment source.
Where refund to the original payment source is not technically possible, NHHA may request appropriate details for an alternative verified payment method.
Any delay caused solely by the Candidate's failure to provide information reasonably required for processing the refund shall not be attributable to NHHA.
15. Acknowledgement
By completing enrolment or making full or part payment towards an NHHA programme, the Candidate acknowledges and agrees that:
- the Candidate has selected a specific programme and has been informed of the applicable Programme Fee;
- where the Candidate selects payment in three instalments, the instalments collectively represent payment of the complete Programme Fee;
- voluntary cancellation or non-participation does not ordinarily result in cancellation of the Candidate's payment obligations;
- payments already made are non-refundable except in the specific circumstances stated in Clause 8;
- unpaid instalments may result in suspension or discontinuation of programme access and withholding of certification;
- full payment of the Programme Fee is required before issuance of a certificate; and
- the Candidate has read and accepted this Policy before completing payment.
16. Governing Law
This Policy shall be governed by and interpreted in accordance with the laws of India in accordance with Clause 1.
Any dispute arising specifically in relation to payments, cancellation or refunds shall be subject to the remedies and forums available under Indian law.
